{"id":1380,"date":"2012-02-09T18:51:39","date_gmt":"2012-02-09T18:51:39","guid":{"rendered":"https:\/\/drugpolicy.ca\/?p=1380"},"modified":"2016-03-01T21:52:40","modified_gmt":"2016-03-01T21:52:40","slug":"c-10-un-cas-de-victimes-c-contrevenants","status":"publish","type":"post","link":"https:\/\/www.drugpolicy.ca\/fr\/c-10-un-cas-de-victimes-c-contrevenants\/","title":{"rendered":"C-10 : Un cas de victimes c. contrevenants?"},"content":{"rendered":"<p><strong>Le 4e\u00a0jour d\u2019\u00e9tude sur le projet de loi C-10 au Comit\u00e9 s\u00e9natorial des affaires juridiques et constitutionnelles a aujourd\u2019hui mis l\u2019accent sur la voix des victimes de crimes.<\/strong><\/p>\n<p>\u00c0 cet effet, plusieurs t\u00e9moins ont soulign\u00e9s l\u2019impact positif qu\u2019aura le projet de loi sur les victimes de crimes, en particulier en ce qui a trait \u00e0 la participation des victimes aux audiences de condition de lib\u00e9ration. Sans d\u00e9faut, tous les t\u00e9moins estiment, par contre, que ces nouvelles mesures ne vont pas assez loin.<\/p>\n<p>D\u2019une part, Sue O\u2019Sullivan,\u00a0ombudsman f\u00e9d\u00e9rale des victimes d\u2019actes criminels, souhaiterait entre autres de meilleurs renseignements ainsi que des pr\u00e9avis donn\u00e9s aux victimes lors du transf\u00e8rement de d\u00e9tenus.<\/p>\n<blockquote><p>Marie-France Marcil, pour sa part, aimerait voir l\u2019\u00e9largissement de la d\u00e9finition du terme \u00ab\u00a0victime\u00a0\u00bb.<\/p><\/blockquote>\n<p>Joseph Wamback, pr\u00e9sident de la\u00a0Canadian Crime Victim Foundation, pr\u00e9conisait lui une plus grande intervention th\u00e9rapeutique aupr\u00e8s des victimes ainsi que des modifications potentielles, par exemple, au r\u00e9gime d\u2019assurance ch\u00f4mage. Il faisait remarquer qu\u2019\u00e0 l\u2019heure actuelle, un parent doit rentrer au travail d\u00e8s 6 semaines apr\u00e8s le meurtre d\u2019un enfant.<\/p>\n<p>Malgr\u00e9 ce que soutiennent \u00e0 r\u00e9p\u00e9tition certains s\u00e9nateurs, la controverse entourant le C-10 n\u2019est pas \u00e0 savoir si le Canada devrait augmenter ses peines maximales pour crimes graves. En fait, les peines maximales ne sont pas touch\u00e9es par le projet de loi. Ce qui pose probl\u00e8me dans le C-10, tel qu\u2019il est r\u00e9dig\u00e9 \u00e0 l\u2019heure actuelle, c\u2019est l\u2019imposition de peines minimales visant les infractions moins graves et non-violentes, tels que les <a href=\"https:\/\/drugpolicy.ca\/fr\/solutions-innovatrices-2\/politiques-cl%C3%A9s\/aller-au-del%C3%A0-de-la-prohibition\/\" target=\"_blank\">crimes li\u00e9s \u00e0 la possession de drogues<\/a>. Des crimes qui, en somme, \u00ab\u00a0franchissent \u00e0 peine le seuil de la criminalit\u00e9\u00a0\u00bb selon\u00a0Giuseppe Battista, du <a href=\"http:\/\/www.barreau.qc.ca\/actualites-medias\/communiques\/2011\/20111020-securite.html\" target=\"_blank\">Barreau du Qu\u00e9bec<\/a>, qui paraissait devant le comit\u00e9 la journ\u00e9e pr\u00e9c\u00e9dente.<\/p>\n<p>Quant au point de vue des victimes \u00e0 l\u2019\u00e9gard de l\u2019imposition de peines minimales obligatoires et autres mesures niant le pouvoir discr\u00e9tionnaire des juges, c\u2019est la s\u00e9natrice Jaffer qui a su poser la question cl\u00e9 de la rencontre : \u00ab\u00a0Est-ce qu\u2019on doit mettre en opposition les droits des victimes aux droits des contrevenants\u00a0\u00bb?<\/p>\n<p>Selon Mme O\u2019Sullivan, \u00ab\u00a0ce n\u2019est pas l\u2019un ou l\u2019autre qui prime, mais il faut y avoir de l\u2019\u00e9quit\u00e9 dans les droits\u00a0\u00bb des victimes et des contrevenants.\u00a0Elle a ajout\u00e9 que m\u00eame si pour certaines victimes, des peines plus s\u00e9v\u00e8res leur sont importantes, pour bien d\u2019autres, la priorit\u00e9 c\u2019est davantage la<a href=\"http:\/\/www.victimesdabord.gc.ca\/media\/nouv-news\/cp-nr\/2012\/20120202.html\" target=\"_blank\">compr\u00e9hension du processus de justice et la possibilit\u00e9 d\u2019y participer<\/a>.<\/p>\n<p>Compte tenu du fait que le t\u00e9moignage du soir pr\u00e9c\u00e9dent soulignait \u00e0 quel point un nombre important de contrevenants sont, eux-m\u00eames, au pr\u00e9alable, victimes de crimes, il serait peut-\u00eatre pertinent de citer ce que disait \u00e0 ce sujet M. Battista\u00a0: \u00ab\u00a0Le but d\u2019une peine c\u2019est la justice, ce qui veut dire \u00eatre juste pour\u00a0tout le monde.
