{"id":1372,"date":"2012-02-16T18:47:04","date_gmt":"2012-02-16T18:47:04","guid":{"rendered":"https:\/\/drugpolicy.ca\/?p=1372"},"modified":"2016-03-01T21:52:26","modified_gmt":"2016-03-01T21:52:26","slug":"securite-publique-et-fondements-de-la-loi","status":"publish","type":"post","link":"https:\/\/www.drugpolicy.ca\/fr\/securite-publique-et-fondements-de-la-loi\/","title":{"rendered":"S\u00e9curit\u00e9 publique et fondements de la loi"},"content":{"rendered":"<p><strong>Aujourd\u2019hui le comit\u00e9 du S\u00e9nat qui \u00e9tudie le projet de loi C-10 s\u2019est ax\u00e9 sur les modifications apport\u00e9es par ce projet aux demandes de transf\u00e8rement des d\u00e9linquants Canadiens condamn\u00e9s \u00e0 l\u2019\u00e9tranger.<\/strong> Les \u00e9changes entre t\u00e9moins et s\u00e9nateurs ont dress\u00e9 un portrait particuli\u00e8rement saisissant de la critique de cette partie 3 du projet de loi.<\/p>\n<blockquote><p>Tel que le disait ce matin l\u2019avocat John Conroy, en somme, \u00ab il semble y avoir un mal entendu profond de la part du gouvernement quant aux objectifs fondamentaux de la loi au Canada. \u00bb<\/p><\/blockquote>\n<p>Ce qui est en question c\u2019est une augmentation du pouvoir discr\u00e9tionnaire du ministre\u00a0de refuser les demandes de transf\u00e8rements de d\u00e9linquants Canadiens \u00e0 l\u2019\u00e9tranger sans avoir \u00e0 donner de justifications claires. Comme le remarquait Nathalie Des Rosiers, avocate g\u00e9n\u00e9rale de <a href=\"http:\/\/ccla.org\/omnibus-crime-bill-c-10\/\" target=\"_blank\">l\u2019Association canadienne des libert\u00e9s civiles<\/a>, le libell\u00e9 actuel du projet de loi, \u00ab selon le point de vue du ministre \u00bb, constitue un choix de mot qui n\u2019est pas digne de la loi. Selon l\u2019article 1 de la Charte, de telles d\u00e9cisions doivent \u00eatre faites \u201ctel que prescrites par la loi\u201d et non tel qu\u2019issues d\u2019opinions particuli\u00e8res, ajoutait-elle.<\/p>\n<p>Certes, l\u2019intention du gouvernement dans cette partie du projet de loi serait d\u2019accro\u00eetre l\u2019importance accord\u00e9e \u00e0 la s\u00e9curit\u00e9 publique dans les d\u00e9cisions d\u2019attribution ou de non attribution de ces transf\u00e8rements. Toutefois, le probl\u00e8me soulev\u00e9 par cette intention, disait Fannie Lafontaine, professeure de droit \u00e0 l\u2019Universit\u00e9 Laval, c\u2019est que cela fait fi des <a href=\"http:\/\/www.cba.org\/abc\/Memoires\/pdf\/11-45-fr.pdf\" target=\"_blank\">fondements m\u00eames de la loi canadienne<\/a>. En d\u2019autres mots, les fondements de la loi canadienne sont clairs en cette mati\u00e8re : l\u2019objectif de la s\u00e9curit\u00e9 publique est mieux servi par le rapatriement d\u2019un Canadien condamn\u00e9 \u00e0 l\u2019\u00e9tranger.<\/p>\n<p>Qu\u2019un d\u00e9linquant Canadien soit rapatri\u00e9 ou non, il doit rentrer au Canada, par moyen de d\u00e9portation, suite \u00e0 avoir purg\u00e9 sa peine compl\u00e8te.<\/p>\n<blockquote>\n<figure id=\"attachment_1658\" aria-describedby=\"caption-attachment-1658\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1658\" src=\"https:\/\/drugpolicy.ca\/wp-content\/uploads\/2012\/02\/court.jpg\" alt=\"CP\" width=\"300\" height=\"168\" \/><figcaption id=\"caption-attachment-1658\" class=\"wp-caption-text\">CP<\/figcaption><\/figure>\n<p>Alors la question n\u2019est pas \u00e0 savoir si nous souhaitons r\u00e9ins\u00e9rer le d\u00e9linquant au sein de la population g\u00e9n\u00e9rale, mais bien comment nous voulons que \u00e7a se fasse.<\/p><\/blockquote>\n<p>Souhaitons-nous que le d\u00e9linquant compl\u00e8te sa peine au Canada, o\u00f9 nous disposons de tout un syst\u00e8me de contr\u00f4le correctionnel afin d\u2019\u00e9valuer le risque de r\u00e9cidive chez le d\u00e9linquant, des mesures de surveillance en place pour assurer des suivis, ainsi que des programmes de r\u00e9habilitation et de r\u00e9insertion sp\u00e9cialis\u00e9s? Ou bien souhaitons-nous qu\u2019il purge sa peine compl\u00e8te et rentre au Canada, sans \u00e9valuation de risque de r\u00e9cidive, sans suivi, sans surveillance et m\u00eame sans dossier criminel canadien?<\/p>\n<blockquote><p>Pour M.
